Alfonse Maputsenyika, 42, appeared before provincial magistrate,
Pathekile Msipa, in March facing charges of indecent assault and for
contravening a section under the Censorship and Entertainment Control Act.
Maputsenyika and the girl’s sister teach at the same school and
are also friends, the court heard. The girl is a form three student at a nearby
secondary school.
The teacher, who was represented by Reginald Chidawanyika, had
denied the charges.
He argued that he was requested by the girl’s sister to monitor
her movements when she (elder sister) had gone to Gweru for a weekend break.
Maputsenyika claimed that when he reported the girl to her
sister after discovering that she was sleeping with some boys in her absence
the girl made then made false allegations.
But Msipa convicted Maputsenyika of indecent assault and
sentenced him to 24 months before suspending 12 months.
A further 12 months were suspended on condition Maputsenyika
completes 420 hours of community service at a local clinic starting on the 17th
July.
For showing the juvenile pornography, he was fined $50 or five
days in jail.
The state’s case was that on the 10th of October 2014, the girl
was left alone after her sister had gone to Gweru for a weekend
Maputsenyika then entered the girl’s sister bedroom and proposed
love to her.
On entering the room, Maputsenyika found the girl sitting on the
bed. He sat close to her and showed her pictures on his cell phone of people
having sex before fondling her thighs.
Prosecutors said the girl jumped off the bed after which
Maputsenyika left the room.
The girl later told the deputy headmistress that her sister was
sending her away to their parents because of false allegations leveled against
her by Maputsenyika.
That is when she also revealed that Maputsenyi a had indecently
assaulted her leading to his arrest.
